A medical marijuana cardholder has had his felony drug convictions reversed on appeal after already having served three years of his sentence in jail. Steve Best picks up the story…
Joshua Brewer was jailed after a police raid on his Medford home in 2009 uncovered a quantity of marijuana. He was jailed for possession and manufacture of cannabis but made an unsuccessful attempt to appeal the verdict in 2010.
Brewer was finally granted an appeal this month, which ruled that there was no concrete proof that he had more than the permitted amount of the drug, as had been originally claimed.
After spending nearly three years of the sentence in jail, Brewer says he will sue the City of Medford and Jackson County Community Justice on grounds that his civil rights were violated during his arrest and conviction.
He will be seeking a total of around $15 million in compensation.
